Any cause of action or claim you have with respect to the Website or Services must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. SeminoleHerald.com or its Parent Company's failure to enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Such proceedings shall be governed by the laws of the State of Florida and within the jurisdiction of Seminole County, Florida. Any award in arbitration shall be limited to monetary damages and shall include NO injunction or direction to any party other than to pay a monetary amount. The arbitrator(s) shall have no authority to award punitive or any other damages not weighed by the prevailing party's actual damages, except as required by statute.
